If the legislature (in this case the people are the legislature) or executive branch pass laws that are unconstitutional then the judicial branch has an obligation to make the law void.]]></description>

					<description><![CDATA[Libertarians of all people ought to recognize the long history of majoritarian erosion of fundamental rights and support the courts for upholding constitutional liberties against the mood swings of the public.

And incidentally, the court is not considering whether Prop. 215 is legal, but how it applies with regard to commercial sales of marijuana, which is a very different animal.

To my knowledge, nobody&#039;s ever been imprisoned in California for raising hens -- but keeping a backyard coop is illegal in many cities because it bugs the neighbors.]]></description>
